Devine Tarbell & Associates, Inc. (DTA) is a
leading provider of relicensing services in the country. DTA has recently
licensed or is currently involved in the relicensing of over 110 hydroelectric
developments, representing an installed capacity exceeding 11,000 MW, with
individual plants ranging in size from 1 MW to 1,100 MW. We are intimately
familiar with each of the three FERC licensing processes, Traditional (TLP),
Alternative (ALP) and the Integrated License Process (ILP).
DTA has full service capabilities in the aquatic
and terrestrial sciences as well as FERC regulatory specialists who focus their
daily attention to monitoring ongoing activities at FERC, resource agencies, and
other groups that could impact the relicensing of our clients’ projects.
Our staff includes fishery and aquatic biologists, water quality specialists,
terrestrial scientists, wetland scientists, wildlife scientists, waterfowl
specialists and specialists in FERC and related regulatory statutes, including
ESA, Fish and Wildlife Coordination Act, National Environmental Policy Act

Osage Hydroelectric Project Strategic Planning and Relicensing, AmerenUE
Devine Tarbell and Associates (DTA) was selected
as Lead Consultant by Ameren UE for the relicensing of the Osage Project. The
Osage Project is located in central Missouri and forms the Lake of the Ozarks.
It is licensed by the FERC with the current license expiring on February 28,
2006.

Priest Rapids Project, 2,140 MW, Public
Utility District No. 2 of Grant County (Grant PUD)
DTA was the Lead Strategic Planning
Consultant to Grant PUD for the relicensing of the 2,140 MW Priest Rapids
Project. The Priest Rapids Project consists of two developments—Priest
Rapids and Wanapum—on the Columbia River each exceeding 1,000 MW. Key
issues over the course of relicensing included competition for the project;
power sales agreements; cumulative impacts; downstream effects (Hanford
Reach); endangered salmon (salmon BiOp) and bull trout; water quality;
public relations; Tribal relations; project economics; recreation; and
maintaining operational flexibility.

Catawba-Wateree Project, 790 MW, Duke Power
Devine Tarbell and Associates (DTA) has been retained by Duke Power
as the lead consultant for the relicensing of the Catawba Wateree
Project. The Catawba-Wateree Project includes eleven reservoirs
and thirteen powerhouses in fourteen counties in North Carolina and
South Carolina. The project is licensed by FERC with the current license
expiring on August 31, 2008. Duke Power is utilizing an enhanced
Traditional Licensing Process (TLP) for the relicensing of the
Catawba-Wateree Project. DTA’s responsibilities and contributions
to this relicensing range from strategic planning to agency
consultation, study plan development/execution and now preparation of
the draft and final license applications.

Penobscot River Projects, PPL Maine LLC (PPL Maine)
In 2003, PPL Maine entered into a Multi-Party Settlement Agreement
(MPA) with the Penobscot Indian Nation, the U.S. Department of the
Interior, various agencies of the State of Maine, and a number of
conservation groups. The MPA was a landmark agreement reached to
resolve all fish passage, energy generation, and Tribal issues
associated with PPL Maine’s Penobscot River Basin hydroelectric
projects. To implement Phase I of the MPA, PPL Maine was required
to file amendment applications to implement fish passage, cultural
resource management measures, and normal pond elevation changes at its
Stillwater, Medway, Milford, Veazie, and West Enfield Projects. In
addition, PPL was required to file a revised relicensing application for
its Orono Project.
